Louisiana Statute of Limitations for Stryker Hip Lawsuits

Could Your Louisiana Stryker Hip Statute of Limitations Be Drawing to an End? Across the United States, the statutes of limitations will differ from state to state, ranging from one year to six. Most states operate under a two-year statute of limitations, however Louisiana is on the low end, offering only one year from the date the injury occurs in which to bring legal action. The Louisiana Stryker hip statute of limitations is extremely important if you are a Louisiana resident who has been injured or harmed by a recalled Stryker hip implant (Rejuvenate or ABGII). The recall occurred in July, 2012, however you may not have discovered your injury until later.

No matter your circumstances, there is no way to really know for sure whether you are entitled to bring a Louisiana Stryker hip lawsuit without speaking to an experienced Louisiana Stryker hip lawyer at the earliest opportunity. You may have extensive medical bills associated with injuries you sustained from a defective Rejuvenate or ABGII, or you may have been forced to undergo Stryker revision surgery due to one of the recalled devices. Either way, you should not be left “holding the bag,” so to speak for injuries received from a device you believed to be safe. In fact, Stryker aggressively marketed both implants in early 2010 as lasting much longer than other hip implant devices and as being much safer than other metal-on-metal hip implants.

Adverse Event Reports and Problems Associated With the Stryker Hip Recall

Despite the fact that adverse event reports began coming in to the FDA shortly after the release of the two implants, Stryker continued to market the devices to the public. By early 2012, over 300 adverse event reports had been sent to the FDA, with many of those coming from surgeons who noted evidence of “black rust” on the Stryker implants removed from their patients. Other consumers found their health had deteriorated quickly since they received a Stryker Rejuvenate or ABGII, as they developed symptoms of metal poisoning due to the chromium and cobalt ions which sheared away from the device during periods of activity, landing in the bloodstream or hip tissues. Symptoms of metal toxicity include the following:

·         Gastrointestinal disorders

·         Reproductive disorders

·         Renal and thyroid disorders

·         Cardiovascular and neurological disorders

·         Depression, anxiety, irritability

·         Changes in DNA

·         The development of pseudo-tumors

·         Changes in taste

·         Memory loss

·         Vertigo

Symptoms of metallosis can include destruction of bone and tissue, acute inflammation, chronic pain in the hip, groin and thigh areas and the complete failure of the hip implant, requiring Stryker revision surgery.

How a Louisiana Stryker Hip Lawyer Can Help

Product liability cases tend to be extremely complex; rather than attempt to wade through the legalities on your own, it is in your best interests to speak to a Louisiana Stryker hip lawyer as soon as possible. Your attorney will assess the details of your case, determining whether you should file a Louisiana Stryker hip lawsuit in order to recover damages, including medical expenses, pain and suffering and, when warranted, punitive damages. Many believe that Stryker was well aware of the potential dangers associated with the ABGII and Rejuvenate, yet continued to sell the devices to the public, choosing financial gain over patient safety. If you have suffered harm from a recalled Stryker hip device, contact a Louisiana Stryker hip lawyer today.

Each client’s case is unique, and the specific circumstances of any individual case can have significant bearing on the applicable statute of limitations.
